Welcome to Wobely. These Terms & Conditions (“Terms”) govern your use of the Wobely platform (“Service”), operated by Wobely, Inc. (“we,” “our,” or “us”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Service Description

Wobely is an AI-powered engagement intelligence platform for creators. It aggregates social media engagement (e.g., comments, messages, mentions) through official APIs, and provides organizational tools, prioritization, suggested responses, audience insights, and moderation assistance

2. Accounts & Eligibility

You must be at least 13 years old (or older, if required by your local law) to use Wobely. You agree to provide accurate account information and to maintain the confidentiality of your credentials.

3. Subscription Terms

  • Trial: We may offer limited-time free trials. Trial access may be revoked at any time without notice.

  • Paid Plans: Access to certain features requires a monthly subscription. Fees are billed in advance and auto-renew monthly unless canceled.

  • Cancellation: You may cancel your subscription at any time via your account settings. Access continues until the end of the billing period.

  • No Refunds: Except as required by law, payments are non-refundable. For special cases and for more information, please email us at hello@wobely.com.

4. Acceptable Use

You agree not to:

  • Use the Service in violation of any laws or third-party terms (e.g., social media platforms’ API terms).

  • Scrape or reverse-engineer the platform.

  • Interfere with our systems or security.

  • Use Wobely for harassment, abuse, or any harmful behavior.

We reserve the right to suspend or terminate your access if you violate these rules.

5. AI and Automation Disclaimer

Wobely uses artificial intelligence and automation technologies to assist users with organizing, prioritizing, summarizing, and responding to engagement across supported platforms.

AI-powered features are designed to provide assistance only. Outputs may be incomplete, inaccurate, or inappropriate in certain contexts. You are solely responsible for reviewing, editing, and approving any AI-generated suggestions before use or publication.

Wobely uses paid, enterprise-grade AI APIs under contractual terms that restrict the use of customer data solely to providing the requested service. Data submitted to such AI services is not used to train or improve generalized AI models.

Platform-Specific Data Handling:

Data obtained via Google APIs (including YouTube APIs) is subject to additional safeguards and is not shared with third-party AI services. Any AI-based processing of Google API data, if enabled, is performed exclusively using Google-provided AI services.

Wobely does not use consumer-facing or publicly available AI tools to process customer data.

6. Third-Party Services

Wobely relies on third-party services and APIs (e.g., Meta, YouTube, TikTok, X). You authorize us to access and process your data from those services according to their terms and our Privacy Policy. We are not responsible for third-party platforms’ behavior or changes.

Certain third-party services may act as data processors on Wobely’s behalf. Such providers are contractually restricted to processing data only as instructed by Wobely and in accordance with applicable privacy, security, and platform-specific requirements.

You acknowledge that Wobely’s functionality may vary by platform based on applicable API terms and policies. Wobely may restrict or modify features to comply with third-party platform requirements, including data usage and processing limitations.

7. Data Handling & Privacy

Your use of Wobely is subject to our Privacy Policy, which explains what data we collect, how we use it, how AI-powered features operate, and how platform-specific data (including Google API data) is handled.

8. Intellectual Property

All platform content, software, and branding are owned by or licensed to Wobely. You may not reproduce, distribute, or exploit any part of the Service without our prior written consent.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that Wobely will be error-free, uninterrupted, or suitable for your intended purpose.

10. Limitation of Liability

To the maximum extent permitted by law, Wobely shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability is limited to the amount paid by you in the 12 months prior to the claim.

11. Indemnification

You agree to indemnify and hold Wobely harmless from any claims or damages resulting from your violation of these Terms or misuse of the Service.

12. Export Controls

You agree to comply with all applicable export laws and regulations. You may not use or access Wobely if you are located in a country embargoed by the United States or listed on U.S. government restricted party lists.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or prominent in-app notice. Continued use after changes means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
